Abstract

Artikel ini membahas persoalan wakaf di Indonesia dengan melihat tiga kasus sengketa wakaf di Pengadilan Agama. Peraturan-peraturan hukum yang terkait dengan perwakafan di Indonesia memang masih memiliki beberapa celah kelemahan yang berpotensi memunculkan perkara sengketa wakaf. Penelusuran terhadap pasal-pasal dalam peraturan tersebut dan beberapa pendapat ahli hukum dilakukan untuk melihat “pencarian kebenaran materiil” dari keputusan-keputusan dalam sengketa
wakaf di atas.
